Understanding the Pattern of International Migration: Challenges in Human Rights Protection Mohammad Thoriq Bahri

Abstract

International Migration can be described as the movement of people from one country to another county. The International Migration is one of the dynamic historical events, which was first legally regulated through the Tanzimat in the Ottoman Empire, signed on the 09 March 1857, which give the people who under the religious prosecuted legal permit to enter Turkey territory. Since then, the mass movement of the people between people becoming very common, especially after World War I, and World War II, when millions of people are moving from one region to another because of the displacement and violence. By utilizing Mixed Migration Center Dataset in 2019, which interviewed 9754 respondents, and the Mexican Government data on Migration in the year 2016, the main pattern of migration and motives are tracked and analyzed. It can be concluded, if the pattern of the migration is from East Africa to North Africa, East Africa to North Africa, East Africa to Southern Africa, East Africa to Europe, the Middle East to Europe, the Middle East to southeast Asia (Indonesia, Malaysia, and Thailand), Bangladesh/Myanmar to Malaysia, and from South America to North America. The motives are economics, Violence and General Security, and Lack of Rights. Still, International Migrants protection becoming a big challenge for many destination countries. From the analysis, can be concluded if the challenges in International Migrants Protection are because of the difference in terms, not all of the destination countries ratified the 1951 Convention about refugees and 1967 protocol as the legal basis and cultural and political context which make society in the destination countries refusing the International MigrantsInternational Migration can be described as the movement of people from one country to another county. Abstract

The increase in domestic violence in Nigeria has become overwhelming. However, the death of Osinachi Nwachukwu (a popular gospel artist singer), which has been linked to domestic violence, prompted the discussion of domestic violence to be more pronounced. Although several laws and institutional bodies are set up to curtail the incidence of domestic violence, there seems to be an increase in the monster in Nigeria. In this regard, this study adopts a hybrid method of research to ascertain the causes of the current increase in domestic violence in Nigeria and proposes judicial separation as a panacea. In this regard, various literature and laws were analysed concerning the suitability of judicial separation as a panacea in curtailing domestic violence. Furthermore 350 questionnaire was distributed to respondents to ascertain the causes of the current increase in domestic violence and possible solution. The study, therefore, found that alcohol abuse, psychological disorder, economic hardship, and traditional belief are some of the causes of the current increase in domestic violence in Nigeria. The study also found that judicial separation could be a viable legal tool to curtail domestic violence, given that it preserves the status quo of the marriage. Therefore, the study concludes and recommends that victims of domestic violence should open up and embrace the concept of judicial separation.

Abstract

Penelitian ini membahas tentang kondisi sistem legalisasi sertifikasi tanah di wilayah perdesaan. Ketentuan-ketentuan tentang pertanahan yang ada di Indonesia dapat diatur dalam Undang-Undang No.5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria atau biasanya lebih dikenal juga dengan UUPA. Adapun tujuan dari penelitian ini adalah untuk mengetahui faktor-faktor dalam kendala pengurusan sertifikasi tanah dan nilai manfaat sertifikasi, skema dan proses alternatif legalisasi serta menyusun strategi keberhasilan dalam sertifikasi tanah di Indonesia. Hasil analisis menujukkan bahwa faktor yang mempengaruhi seseorang berkeinginan untuk melakukan sertifikasi tanah yang paling dominan adalah dapat menambah nilai objek tanah, mengurangi rasa ketakutan kehilangan tanah, dapat mengurangi sengketa tanah, meningkatkan investasi dan memudahkan akses permodalan. Skema dan kemudahan proses legalisasi dalam sertifikasi tanah diperlukan pemahaman bagi masyarakat untuk memperhatikan persyaratan dokumen sertifikasi tanah, mengetahui kegiatan pengukuran dan pemetaan bidang-bidang tanah hak dan pendaftaran bidang tersebut dalam daftar tanah, serta memfollow up status penerbitan sertifikat petugas BPN. Keberhasilan dalam sertifikasi tanah di Indonesia perlu upaya sosialisasi oleh pemerintah baik dari tingkat Kelurahan, Kabupaten/Kota bahkan dari Pusat agar informasi terkait sertifikasi dapat diterima dan masyarakat mengetahui manfaatnya serta adanya sosialisasi terkait standar pengurusan sertifikat tanah, pembuatan manual book atau tata cara pengurusan sertifikasi tanah untuk dapat didistribusikan pada masyarakat baik dalam bentuk online maupun textbook. This study discusses the condition of the land certification legalization system in rural areas. The provisions on land in Indonesia can be regulated in Law No. 5 of 1960 concerning Basic Regulations on Agrarian Principles or usually better known as UUPA. The purpose of this research is to find out the factors in the constraints in obtaining land certification and the value of the benefits of certification, alternative legalization schemes and processes as well as formulating a strategy for success in land certification in Indonesia. The results of the analysis show that the most dominant factors that influence a person's desire to certify land are being able to increase the value of land objects, reducing the fear of losing land, reducing land disputes, increasing investment and facilitating access to capital. The scheme and ease of the legalization process in land certification requires understanding for the community to pay attention to the requirements for land certification documents, knowing the activities of measuring and mapping parcels of land rights and registering these fields in the land register and following up on the status of issuance of certificates by National Land Agency (BPN) officers. Success in land certification in Indonesia requires socialization efforts by the government from the Village, Regency/City levels and even from the Center so that information related to certification can be received and the community knows the benefits as well as socialization related to land certificate management standards, making manual books or procedures for obtaining land certification. to be distributed to the public in both online and textbook form

Abstract

President Joko Widodo stated that Indonesia intended to join the Trans Pacific Partnership (TPP). In international treaties, when a country becomes part of international cooperation, the country is obliged to adjust its national law. The TPP consists of 30 Chapters, where the regulation regarding e-commerce is specified in Chapter 14. If Indonesia becomes part of the TPP, then the domestic e-commerce regulations must be adjusted according to the provisions that apply to the TPP. By employing the normative legal research method, this analysis aims to analyze laws and regulations related to e-commerce in Indonesia and e-commerce provisions in the TPP and identify the gaps between them. The results of the analysis show that if Indonesia joins the TPP, the Indonesian government needs to make adjustments to several regulations, such as Law Number 11 of 2008 as amended by Law Number 19 of 2016; Law Number 7 of 2014) of Law Number 11 of 2020; Government Regulation Number 71 of 2019; and Government Regulation Number 80 of 2019. Presiden Joko Widodo menyatakan bahwa Indonesia bermaksud untuk bergabung dengan Trans Pacific Partnertship (TPP). Dalam perjanjian internasional, ketika suatu negara menjadi bagian dari suatu kerjasama internasional, maka negara tersebut wajib menyesuaikan hukum nasionalnya. TPP terdiri dari 30 Chapter, dimana pengaturan mengenai e-commerce terdapat pada Chapter 14. Apabila Indonesia menjadi bagian dari TPP, maka regulasi e-commerce di dalam negeri harus disesuaikan menurut ketentuan yang berlaku pada TPP. Dengan menggunakan metode analisis yuridis normatif, tulisan ini bermaksud untuk menelaah peraturan perundang-undangan mengenai e-commerce di Indonesia dan ketentuan e-commerce dalam TPP serta menganalisis kesenjangan di antara keduanya. Hasil analisis menunjukkan bahwa apabila Indonesia bergabung dengan TPP, maka pemerintah Indonesia perlu mengadakan penyesuaian terhadap beberapa peraturan dalam Undang-Undang Nomor 11 Tahun 2008 jo. Undang-Undang Nomor 19 Tahun 2016; Undang-Undang Nomor 11 Tahun 2020; Peraturan Pemerintah Nomor 71 Tahun 2019; dan Peraturan Pemerintah Nomor 80 Tahun 2019.

Abstract

The purpose of writing this research is to find out and analyze the implementation of the measurement and mapping of the land base map so that it can be legal certainty and beneficial for the people and the country, this research uses the normative juridical approach method. The results of the research indicate that the implementation of the measurement and mapping of the land base map is a legal certainty and provides another benefit of the certificate of right to the land is that it can provide a sense of security and peace for the owner, everything is easy to know and its nature is certain and can be held legally accountable.
